Counterfeit (lookalike) IP Protection

Counterfeiting is endemic for many brands. Counterfeiting goes beyond the prolific worldwide problem of “knock-offs” of luxury prestige brands being sold by street traders to customers who are entirely aware that the products are fake and would not be prepared to pay the full price for the genuine product in any case. Counterfeiting extends to deliberate copying where products are fraudulently offered as the genuine product resulting in a loss of profit to the brand owner, damage to the authorised supply chain and ultimately the brand itself.

Intangible Business has worked with a number of businesses and brands to develop anti-counterfeiting strategies and IP protection strategies. Our team of experienced accountants and marketers understand how consumer behaviour is impacted by counterfeiting.

Intangible Business can quantify the actual losses that have resulted from counterfeit activity and calculate the long term damage to the brand. This analysis helps companies decide where to allocate resource to limit damage to the brand from counterfeiting. The resulting valuation enables the brand owner to determine the best course of action to pursue in order to limit the damage and value lost.

Should this result in litigation, Intangible Business’ experienced team of expert witnesses are ideally placed to demonstrate in court or arbitration how counterfeiting has impacted sales, quantify the actual losses to date, and estimate the future losses which arise from brand damage.

Our experts are members of The Institute of Chartered Accountants in England and Wales, The Institute of Chartered Accountants of Scotland, The Chartered Institute of Management Accountants, The Academy of Experts, The Society of Expert Witnesses, The Expert Witness Institute, Accredited Expert Witnesses and Accredited Forensic Accountants approved by the ICAEW and have supplied evidence for courts in Australia, UK, France, USA and all over the world.
